These Terms of Use ("Terms") govern your access to and use of the Ummy® Kids Daily Nutrition Tracker ("the app," "the service"), operated by Superfood Organics LLC dba UMMY® and accessible at ummy-nutrition-tracker.web.app. By creating an account or using the service, you confirm that you are at least 18 years of age and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

Ummy® is a dietary pattern tracking tool designed to help parents and guardians log and monitor their children's food intake and understand how it compares to age-appropriate Dietary Reference Intakes (DRI) established by the National Academies of Sciences, Engineering, and Medicine.

The app provides:

• Food logging and nutrient tracking against DRI benchmarks
• Visual summaries of nutritional patterns over time
• A simulation tool showing the potential nutritional contribution of Ummy® superfood shakes
• A printable summary report for use at pediatrician visits
• Parent sharing features allowing two caregivers to share access to a child's log

3. Not Medical Advice — Important Disclaimer

Specifically:

• The nutrient percentages shown in the app reflect dietary pattern tracking against general population DRI benchmarks. They do not account for your child's individual health status, growth measurements, metabolic conditions, allergies, or clinical needs.
• A low percentage for a nutrient does not mean your child has a nutritional deficiency. It indicates a dietary pattern gap relative to general recommendations.
• The Ummy® Simulation is an illustrative tool based on product nutrition label data. It is not a health claim or guarantee of any health outcome.
• The pediatrician report is a dietary tracking summary intended to facilitate conversation with your child's healthcare provider. It is not a clinical assessment.

Always consult your child's pediatrician or a registered dietitian before making significant changes to your child's diet, especially if your child has a medical condition, food allergy, or special dietary need.

4. Eligibility and Account Responsibility

You must be at least 18 years old to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring that any co-parent you share access with understands and agrees to these Terms
• Providing accurate information when logging food and setting up child profiles

You must not share your account credentials with anyone other than a co-parent or caregiver using the parent sharing feature.

5. Accuracy of Information

Food nutrition data in the app is sourced from the USDA FoodData Central database and Ummy® product nutrition labels. While we take care to ensure accuracy, we do not guarantee that nutritional values are error-free or reflect the exact nutritional content of every food as prepared and consumed in your household.

DRI values are based on the most current guidelines published by the National Academies of Sciences, Engineering, and Medicine at the time of the app's last update. These values may change as new research emerges.

6. Acceptable Use

You agree to use Ummy® only for its intended purpose of personal, non-commercial dietary tracking for your family. You agree not to:

• Attempt to access, tamper with, or disrupt the app's infrastructure or other users' data
• Use the app for any commercial purpose without our written consent
• Reverse engineer or attempt to extract the app's source code or data
• Submit false, misleading, or harmful information
• Use the app in any way that violates applicable laws or regulations

7. Intellectual Property

All content, design, code, and materials within Ummy® — including but not limited to the app interface, brand name, nutrition analysis methodology, and written content — are the property of Ummy® and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the app without our express written permission.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Ummy® and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to reliance on nutritional data displayed, dietary decisions made based on app output, or any health outcomes for your child.

Your use of this app is at your own discretion and risk. The app is provided "as is" without warranties of any kind, express or implied.

9. Service Availability

We strive to keep Ummy® available at all times, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue the service at any time with or without notice. We are not liable for any loss or inconvenience resulting from service interruptions.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. If changes are material, we will notify you by email. Continued use of the app after updated Terms are posted constitutes your acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Los Angeles County, California.
